Terms of Service
1. Acceptance of Terms
By creating an account, browsing, or using Piston Marketplace (“the Site,” “we,” “us”), you agree to these Terms of Service. If you do not agree, do not use the Site.
You must be at least 18 years old to create an account or use the Site.
2. What Piston Marketplace Is and Isn’t
Piston Marketplace is a listing platform that allows individuals and businesses (“Sellers”) to advertise piston aircraft, parts, and related equipment for sale to prospective buyers (“Buyers”).
We are not a party to any transaction between a Buyer and Seller. We do not own, inspect, appraise, verify the airworthiness of, or guarantee the condition, safety, legality, or accuracy of any aircraft, part, or listing on the Site. We do not broker, facilitate payment for, or guarantee the completion of any sale.
Buyers and Sellers are solely responsible for their own transactions, including but not limited to: verifying the accuracy of listing information, conducting pre-purchase inspections, reviewing logbooks and maintenance records, verifying registration and title, arranging financing, escrow, or payment, and complying with all applicable FAA regulations and other laws.
We strongly recommend that any aircraft purchase include an independent pre-purchase inspection by a qualified mechanic and a title search prior to completing any transaction.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and when creating listings.
We reserve the right to suspend or terminate any account, at our discretion, for violations of these Terms, suspected fraud, misrepresentation, abusive conduct, or any other reason we deem necessary to protect the integrity of the Site.
4. Listings
By creating a listing, you represent that:
- You have the legal right to sell the aircraft, part, or item listed
- The information provided is accurate and not knowingly misleading
- The item is not stolen, subject to an undisclosed lien, or otherwise encumbered in a way not disclosed in the listing
- You will honor the price and terms stated in the listing in good faith
Listing fees are non-refundable once a listing has been published, except at our sole discretion. Listings run for the duration stated for the plan purchased (currently 30 days for Basic, 60 for Featured, and 90 for Premium) and may be renewed for an additional fee.
We reserve the right to remove any listing, at any time, for any reason, including but not limited to suspected fraud, prohibited items, inaccurate information, or violation of these Terms.
Prohibited Listings
You may not list: stolen aircraft or parts, items you do not have the legal right to sell, counterfeit parts, aircraft or parts subject to an undisclosed airworthiness directive violation or known safety defect that is not disclosed, or any item whose sale would violate federal, state, or FAA regulations.
5. Fees and Payment
Current listing fees and tiers are posted on the Site and are subject to change. All fees are charged in U.S. Dollars unless otherwise stated. Payment processing is handled by a third-party payment processor; we do not store your full payment card information.
6. User Content
By submitting photos, descriptions, videos, or other content to a listing (“User Content”), you grant Piston Marketplace a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Site.
You represent that you own or have the right to use any content you upload. We reserve the right to remove any User Content that we believe violates these Terms or applicable law.
7. Communications
The Site provides tools for Buyers to contact Sellers regarding listings. We are not responsible for the content of communications between users, and we do not guarantee that any Seller will respond to inquiries.
8. Disclaimer of Warranties
THE SITE AND ALL LISTINGS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTING OR USER CONTENT.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PISTON MARKETPLACE AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY TRANSACTION OR DEALING WITH ANY BUYER OR SELLER ON THE SITE; (C) ANY AIRCRAFT, PART, OR ITEM PURCHASED OR SOLD THROUGH A LISTING ON THE SITE, INCLUDING ANY SAFETY-RELATED INCIDENT.
10. Indemnification
You agree to indemnify and hold harmless Piston Marketplace from any claims, damages, losses, or expenses arising from your use of the Site, your listings, or any transaction you enter into with another user.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Michigan.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
